Informations and request of consent on treatment of personal data.

In compliance with the regulations in force contained in the Governmental Decree dated 30 June 2003 nr. 196 in matter of personal data treatment (so called Codice della Privacy) become effective the 1st January 2004, we hereby inform you that the Company Aignep S.p.A. with Head Office in via Don G. Bazzoli 34 – 25070 BIONE (Bione) Italy – in the following text named "Company" – will provide to hold your personal data sent to us either by yourself or by other people/bodies.

This treatment will be made according to the prescriptions as follows.

1. Purposes of the treatment

  1. The treatment of personal data is exclusively made in order to achieve the following purposes:

    a) in order to enable the counterparties to sign pre-contracts, to carry out the same ones and to protect the creditors;

    b) to fulfil whatever obligation prescribed by law, particularly in fiscal matters;

    c) for managing purposes;

    d) in order to access the web site of the Company and the related services;

    e) in order to control the current state of affairs with our customers ans related risks;

    f) for commercial purposes and strategic marketing.

    The data treatment could consist in registering, holding, communicating, cancelling, passing them on and will be made either on paper or with the help of magnetic storage medium with all the precautions in order to guarantee the security and privacy of the people as prescribed by art. 31 and others of D. Lgs. 196/2003, regarding "minimum requirements of security for the treatment of personal data" as in the Allegato B of the same Decree as well.

    The access to the data will be possible only to people authorised by the Company.

    3. Handover of data

    The handover of personal data will take place only when:

    1. this action is mandatory in order to ensure the obligations prescribed by law;
    2. this is necessary to prosecute the business relations.

    Any eventual denying the consent will produce the impossibility – on our side – to prosecute

    our business relation or to carry out your orders and related services.

    4. Diffusion of data

    The above mentioned data can be passed on to private and pubblic bodies either natural or legal; to people for commercial ends or for managing IT systems included third companies. This can happen for two reasons:

    1. because beeing mandatory by law;
    2. because this action is required to carry out the business relation with you.

    The data specifically can be handed over to: banks, commercial net, companies specialised in payment management, law offices and consultants, auditors, authorities, Italian and foreign suppliers, forwarders and to companies owned by our Company.

    In addition to that your data can be given to third parties but in anonymous format for statistical researches.

    Transfer of data to foreign countries

    For purposes strictly required by our contract, your data can be given to third parties across the European Union.

    6.

    Rights of the people involved

    According to the art. 7 and others of D. Lgs. 196/2003 you have the right:

    1. to obtain confirmation of existence of your personal data at our Company;
    2. to obtain from the Company any information about treatment, custody and holding in electronic format;
    3. the identity of people treating your data and eventually the representative in Italy of a foreign company;
    4. details of people who can get your data.

    to obtain:

    1. to update your data;
    2. the cancellation, the conversion into anonymous form or to prohibit the misuse in violation of laws;
    3. the confirmation that the actions under points 1 and 2 have been taken to knowledge

      of people involved except the case in which the communication is impossible or with no proportion between the means requested and the rights safeguarded;

    4. to prohibit the treatment for legitimate reasons although legal;
    5. to prohibit the treatment for commercial purposes, market research or to send advertising materials;
    6. The above mentioned rights can be personally exercised or by a third party/person on your behalf with your authorization.

    We would like to inform you that the consent you give is not mandatory. In case you do not authorize the treatment, the Company will not be able to handle, but only use them as prescribed by law with the consequences enumerated in the point 3.
